Recently released figures published by Pat Maloney, a blogger at Run with Life, prove that Canada’s justice system is failing vulnerable children before as well as after birth. Ms. Maloney reported that, from 2000 to 2009, 491 babies have been born alive following a failed abortion procedure, and subsequently left to die. And those are only the ones that are recorded by Statistics Canada.
The Supreme Court of Canada struck down this country’s abortion law in 1988. Yet there remains some legislation that deals with children just prior to and immediately following birth. Section 238(1) of the Criminal Code states, “Everyone who causes the death, in the act of birth, of any child that has not become a human being, in such a manner that, if the child were a human being, he would be guilty of murder, is guilty of an indictable offence and liable to imprisonment for life.”
Ms. Maloney explains in her blog, “there were 491 abortions, of 20 weeks gestation and greater, that resulted in live births. This means that the aborted child died after it was born. These abortions are coded as P96.4 or ‘Termination of pregnancy, affecting fetus and newborn’.”
As the letter states, our lawmakers need to address how these vulnerable children are being treated.

These abortions are coded as P96.4 or ‘Termination of pregnancy, affecting fetus and newborn’.
The Criminal Code in Section 223(2) reads “A person commits homicide when he causes injury to a child before or during its birth as a result of which the child dies after becoming a human being.” Clearly there needs to be an investigation into the deaths of these 491 babies.
As you are aware, the rights of pre-born children in Canada are not recognized at any point during the time the child is in the womb of his/her mother. This revelation though, that some babies are born alive following a failed abortion procedure and then subsequently left to die is something that needs to be addressed. The new Justice Minister, Peter MacKay is included in this email and I urge you to work with him in standing up for the rights of these vulnerable children.
